. My company people told me that they would be mailing the h1 transfer application on april 24. And hence i can join on April 28. So i joined and started working from them. i trusted my company and never asked for copy of receipt notice or case number. Few months later, i got H1b approval. Hence never thought there was any problem, until recently when i realized that Receipt Date on the H1b approval notice is May 15.
This difference b/w my actual joining date i.e. April 28 and Receipt Date on H1b Notice i.e. May 15 is causing the concern
Any advise in this regard is appreciated.

My company wants to transfer me to Europe for 2 yrs. Its a very good opportunity for my career. My I140 approved and 485 is pending. PD March 2006 EB2 India. It wont become current for foreseeable future. I am appplying for 3 yrs of H1B extension.
Can I be outside the US for 2 yrs w/o jeopardizing the GC process. Can I then come back after 2 yrs on stamped H1?
My wife used EAD to work. Can I apply her H4 extension with me and she foregoes her EAD? Will she get H4 status and extension along with my H1?
Can she then come back with me after 2 yrs on H4 and then revert back to EAD to work?
I need to make a decision soon. Any replies will be greatly appreciated!

Yes you can do this...just call the embassy....Indian ambassy is pretty fast....to help on this...

I have to do a emergency travel to India and I did not get my advance during that time. I went to USCIS office in person and got the advance parole and flyed to India.
Back in US I learnt from my wife that I got another copy of Advance parole which I have applied earlier. Both Parole documents look different in format and the one which I got from USCIS office does not have the SRC nubmer on it.
If my wife sends the recent Advance Parole documents via FEDEX, not sure which document I should show up at port of entry..Plese help.

I donot have my middle name mentioned in H1 anywhere although i filled my application with correct middle name. Its very common to not have midlle name mentioned by USCIS in application.
I have a spelling errors in last name in visa, no problems ever.
There are ways other than "Middle Name" to figure out who you are based on your appliation. So donot worry too much about it.

My question-If i apply for h1b transfer to non-cap without working for cap company in 7-10 days and later If I want to join a cap company,will I have to go through the lottery again -basically will i be subject to cap.
2.what is the proper process for transfer to occur.

My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.

I am sorry to ask...If H1B doesn't have I-94 attatched to it and it was approved when my friend was in india, he can work on L1. My question is, if he moves out of country and get H1B stamped, can he work on L1?

This will be a new H1 application since you never used the original one. You will need to go to the US Consulate with the new approved H1 document and they will ask you why u forsook the first one....

This question is implying that the stay for the children to go to school in canada would only be a month or so, not more than six months - so does anyone know if there's a risk in messing up the green cards while the family waits a month in canada while waiting for the next destination.

I applied for I 485 , AP and EAD during 07 July. I got a fp notice back in 2007 and I got another one two weeks ago. I went ahead and did my bio-metrics over the weekend at TSC Application Support Center.
Does this mean that somebody has looked into my file and pre adjudicated it? or is it a automated thing and does not mean anything?
Please advice!

I applied for a green card for my wife just after we were married on May 11, 2009. We received an appointment for an interview in Detroit on August 25, 2009, but we had moved to Texas in the meantime. The appointment was rescheduled at the Dallas field centre on September 14, 2009 (Monday).
I am wondering what to expect, from the small details to the big stuff. My 3 biggest questions:
. Does anyone have enough experience to say if there is there reasonable parking available at the field centre? I have never been to Irving. The web page says that there is public parking available, but nothing about how much.
. I was married before, and applied for a green card for my first wife. It was granted in 2004, and we divorced in 2006. Should I expect extra scrutiny / challenge because of this?
. Is one actually asked questions of the "What sort of toothpaste does your wife use?" variety? I'm really bad at remembering these details, and am wondering if there's any curve ball that I should expect.
. Is there a general impression of whether the Dallas field centre is a pleasant or an unpleasant place? My dealings with my first marriage (many years ago) were all with the Chicago field centre, which is very unpleasant, but my one piece of business with the Detroit field centre were easy and pleasant.

UPDATE: I forgot to ask another one: At my previous green card interview, the interviewer asked for a set of passport photos and paystubs for several previous months, although the interview letter had not requested them. Is there anything else that I might be expected to bring that wouldn't have been mentioned on the interview letter?

Whereas appeal to I-140 is 21 month delay so I assume that I-140 will take its own sweet time. But What about appeal to I-485 which is current. Am I going to get any response on I-485 appeal process soon?? Anyway thanks for sharing your experience with me.
When 140 is denied, then 485 is also denied. Appeal going to AAO is common thing. Will sit there forever. Its takes approximately 12-20 months to get a reply.
Mine is already crossed 12 months now.

Did you try to expedite?
I think you qualify for expedite criteria since not getting EAD will force you to stop working and cause severe financial hardship.
