i think majority of the Eb2 filings are under audit..
i ran my first ad..this sunday..and my lawyer didnt say a thing abt change in perm process.. but he did mention that Eb2 are being scrutinized more.
i think ur desi consultant is afraid of being under the scanner ! ;)

Dear Core Team,
Can you please indicate on the site if there are any bills (pending or otherwise in both the house and senate) that can get renewed focus or revived that would offer some sort of relief to the current situation of unavailability of visa numbers in the employment based green card process. I strongly feel that the current momentum and attention being drawn by the DOS/CIS update can be used to urge congress to pass some interim measure outside of CIR. That is where in my opinion should IV's focus be at this juncture. If and when you post anything on the site, i and other IV members i'm sure shall begin calling house reps. and senators to urge them for bringing the bill to the floor so that it provides relief to hundreds of thousands of legal immigrants.

We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?

Myself and my wife are both on H1-b. Our 485 was applied in Jul 07. I have to apply for EAD by myself. Can I apply for EAD now and then apply for AP(I-131) at a later time ?

When will they post inventory data? I got bored with analyzing/looking May 2010 inventory. EB3 filers like me needs something to munch on for next couple of years.

Hi,
First my 140 was filed in first week of april and got receipt notice with received date as 11-Apr-08, and in May it was rejected because of check bounce issue.
Again my 140 was refiled in july,and got my 140 receipt notice with received date as 24-Jul-08.
(My labour was approved on 23-Jan-08 and its expiration date is 21-Jul-08,
i think there is rule that 140 should be filed before 180 days of labour approval)
My lawyer is saying:
we first filed it well before the dates,so you should not have a problem, as this is refiled in follow up to the original one.
I am still wondering the USCIS will process my 140.

Hi,
I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?

You can change the job peacefully using AC21 since your 485 is pending for more than 6months. Your labor position/location etc doesnt mater. Your current employer cannot do anything but you need to get a copy of labor and I140 from him to use AC21. Also your next job should be same or similar to the one in the labor certification. Hope this helps.

Australian Immigration Minister Chris Evans announced recently a new agreement between Australia and New Zealand to improve identity checks and border security. Australia and New Zealand recently signed a memorandum of understanding [MoU] to share biometric data, an agreement that will further strengthen our nations' border security. Each month, annual preferences and foreign state limitations are subdivided by the Visa Office into monthly portions based on the applicants reported at consular posts and CIS Offices. If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�

I am working for one of the largest companies as mechanical engineer. I am shifting from Mechanical engineer to program manager job within the same company. The job requirement is
BS + 2-5 years of experience
I have
Bachelors 4 Years
Masters in USA
Research Assistant 1 year 8 months
Teaching Assistant 11 months
Experience as a Mechanical engineer 3 years 8 months
Am I eligible for eb2 category? Help greatly appreciated.

I am in MD and 140- is already approved, 485 filed on 12th July at Nebraska, where to file EAD and 131. ?
If you have the receipt notice of I485, then find out the A# from it. Then apply for EAD and AP online( you need to fill A# at one place in both EAD and AP forms online). They can be applied together(online) but I don't know about applying by mail as I always applied for EAD and AP online.

I am in my seventh year of h1. I applied for one year extension.Not granted yet.
So do I have to wait to get the extension approved ? Can I get my 140 approval and re-appy for 3 year extension and then make the move ?

I-765 and I-512L were issued months ago but there is no news yet for I-140 and I-485s yet for the ones applied in June 30, 07. Any idea?? Would be a great help.
