Hi everyone,
I'm thinking of going into graduate school next year under F-1 status, which presumably should last until the end of my program in 5-8 years. As many of us are painfully aware, students aren't allowed to work except on-campus or as part of approved OPT and CPT programs.
My question is: is it possible for me to take out a TN (NAFTA) visa during the summer of one of my years so that I can work? F-1 and TN are both non-dual intent, so is it possible?

concurrent filing means filing of I-140 and I-485 together not two I-140s.
why do you want to put false data on your profile? such as EB1 at Perm stage with 2000 priority date?
Are you trying to mock all the IV members? Or just being silly?
by concurrent i meant can you file two i-140s under the same EB2 category [regular and NIW] at the same time??
P.S.-regarding my profile that's the default setting w.r.t priority date etc when i set up my account., trying to edit this

When 140 is denied, then 485 is also denied. Appeal going to AAO is common thing. Will sit there forever. Its takes approximately 12-20 months to get a reply.
Mine is already crossed 12 months now.

Can I work for my current employer on H1B and also take up some part time job to work for some other employer on EAD? In doing so, are there any risks involved with respect to Green Card?. Please suggest regarding this.

My friend do not dream for EB3 approval until EB-2 get current. I lost my hope for GC just use EAD.

Hi,
A consultancy firm applied for my H1b Visa this year (2009). USCIS has denied the visa showing the reasons like:
1) My manager (CEO of the company) and the person I will work under (From the client company) is different.
2) They questioned in same line about the place of my work.(office of the firm and the client).
3) They have some points regarding wages of previously employed H1bs of the firm.
There's no point however about my qualification and experience (I have a degree from IIT and work at India branch of one US multinational). The company says that they have a number of approvals this year and the particular decision depends on the officer at USCIS to a large extend. They can re-appeal addressing all the concerns mentioned by USCIS.
How much are the chances are that a denial would be converted to approval. Is the USCIS going to be very strict and judgmental about the re-appeal of the denial?. May be it is hard to tell, by I greatly appreciate any help/suggestion...

I am creating this post to benefit all.
Also this case is about my friend.
He shared all this information with me.
This is a Pittsburgh PA based case, YMMV.
My friend who has an approved labor/i140 and also a pending i485, received a news that his father was ill in India. He wanted to fly to India right away but his AP had expired. Here is what our Internal Immigration lawyer suggested him....
"You must go to the district office to screen and make a determination as to whether your situation is a qualifying emergency. They are responsible for accepting and processing the I-131 in emergency situations. Here is a link to the address and appointment procedure for the Pittsburgh office. https://egov.uscis.gov/crisgwi/go?action=offices.detail&office=PIT&OfficeLocator.office_type=LO&OfficeLocator.zipcode=15220 You should take a completed I-131, $305 filing fee, 2 passport photos, passport (and copy), I-94 copy and evidence of your father�s situation. Remember that you have to prove that this is a medical emergency."
So he took an Infopass appointment, which he got for the very next day! He then visited the Pittsburgh local office (which is normally not so busy) with a completed i-131, photos, fees, passport, copy of passport, i-94 and a FAX proof from India Doctors which explained his fathers situation.
An interview took place, where they asked expected questions and then an Internal Director approved. He was told to wait for 1 hour and he was handed 2 copies of temporary Advance Parole which is valid for 4 months.
I myself was wondering if one can get emergency advance parole and this example shows that if you show all the proof and go to a local office they will help you as much as possible and also give you an AP within 1-2 hours.
(The only bad thing is, my friend will have to spend $305 again for an approval which lasts for 1 or 2 years)

IV needs volunteers
As the time approaches for heated immigration debate on the Hill, behind the scenes IV activities are also are also going to increase. IV core members have full time jobs and thus we need more hands to share the mission we have all been working on.
This is a request to IV members if they are willing to spare a few hours everyday for some IV's work. This work will involve writing lots of emails (a template will be provided) and making phone calls.
We all are going through a lot of frustration due to the delays in our green card processes and I am sure highly skilled and educated spouses that are on H4 would have more than our share of pain due to not having any work permit. If we could have such volunteers who can devote few hours during the day for IV it would a Big help. With everyone's effort and support we will surely succeed.

I need advice/thoughts from you on some of the questions below. Any response will be really appreciated.
1. Got my 485 approval and GC (phycical Card) in hand. What is next? Do I need to get a Infopass appointment and get stamped before any abroad travel?
2. Before receiving 485 approval, my wife and kid went on a Vacation(abroad). Their H4 visa expired on passport, but they have h4 extension/approval till 2010? I was thinking of sending them to H4 stamping, but now that I have 485 approval for them, What should I do? Just bring them here and show GC at port of entry? (Ofcourse, I'll take their GC go abroad and bring them back)?
3. Anything i should be aware or concern about these situation?

I've not get EAD and AP and been waiting for last few months. My wife got both EAD and AP. Is it good idea to call USCIS I/O about my status of EAD and AP? I applied for all 485/EAD/AP in june last week and got the notice on Aug 15th. Please check my signature for more information.

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

When you did your FP, for what particular benefit it was intended? Was it strictly for 485 or was it combined for 485 and 765? If it was just for 485 - why do you expect it appear on your 765 and EAD card? As far as it known, 485 and 765 are complete different things and not related to each other in any way. Didn't you know that?

Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?
Thank you for any and all help you can provide.
