Dear Core Team,
Can you please indicate on the site if there are any bills (pending or otherwise in both the house and senate) that can get renewed focus or revived that would offer some sort of relief to the current situation of unavailability of visa numbers in the employment based green card process. I strongly feel that the current momentum and attention being drawn by the DOS/CIS update can be used to urge congress to pass some interim measure outside of CIR. That is where in my opinion should IV's focus be at this juncture. If and when you post anything on the site, i and other IV members i'm sure shall begin calling house reps. and senators to urge them for bringing the bill to the floor so that it provides relief to hundreds of thousands of legal immigrants.

Hello Everyone,
We are currently evaluating our options of starting a business on EAD, which should be coming within 3 months of filing of I485 in July. Does anyone know if I or my wife can start a business on EAD, are there any issues with it?

Any significant absence from the US can lead to a finding that one has abandoned permanent resident status. Such determinations are very fact specific. It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

My current title is Software engineer and my company is promoting me to Senior Software Engineer. I am on H1 and have filed I-485 in last July and also have approved I-140. This is just the title change and my duties will be same.
(1) Does my company need to file H1 amendment to keep me on H1 or do I have to necessarily switch to EAD?
(2) Does anything changes with respect to GC process?
(3) Do I need to have any specific paper work from the my company that job duties are same?
Any help is greatly appreciated.

My husband was an Asylee (approved asylum) when he got married to me. But he got the Green card through me. I am a US citizen. Now he wants to apply for Citizenship through me.
when we applied for his Green card he had to renew his passport of his country of citizenship. it was one of the requirements. That country of citizenship was obviously also the county of his persecution. there was absolutely no issue about it at the time of his Green card interview.
But could it be a problem for citizenship interview?
He never traveled to his country of citizenship nor to any other place. He has never left USA ever since he came here. Does his asylum case will again surface at the time of citizenship even when he is applying for citizenship through me?My understanding is that the asylum thing is no more the issue if he got the GC through me??
Your advice, input and suggestions will be highly appreciated.

Surely won't fly.
I-140 doesn't belong to the employee. Period.
Then ownership of I-140 needs to change as well. Maybe this is something we could all work in the long term.... and not an immediate goal at this time. Of'course this will need help from everybody on the forums. Something like this is sure to help all of us.

I'm talking about post completion OPT - if you have ur EAD card, u can travel with a valid and current employment letter. When it's pre-completion OPT, u r on F1 anyways so u should get stamping...

can someone pls help me with a few question on re entry permit. i will be going back to us after 1year 8months. i had applied for re entry perit in oct 2007 - i left us in may 2008 - my re entry permit is valid till july 2010. i will be going to us in feb 2010. my question is will i have problem because i left us before i got my permit. my husband who was still in us got my permit for me.
As far as my understanding goes, as long as you applied for the permit while in US, you are good. It should not matter if you got your approval after you left the country.
Please do check with others as well.

Hi people, I am currently applying change of status from H1 to F1. Since my PERM got audit, and my h1 visa is going to expire in the end of January 2009, I need to change my status to F1 student visa in order to stay in the U.S legally. Now, I am trying to fill out the form I-539 by myself, and I got confused on:
part 4. additional information on 3g:"Have you, or any other person included in this application, been employed in the U.S. since last admitted or granted an extension or change of status?"
I don't know should I put "YES" or "NO", I have never done "i-539 for change of status" on my first F1/OPT to H1 visa....but I actually worked in the U.S...
Can anyone help me to answer that? thanks a lot!!!

I think you can go for stamping. Instead of Paystubs you better wait till you get your W2 and then go. But carry paystubs with you and show them if they ask.

The Council of Graduate Schools (CGS) issued an August 20, 2009 press release, reporting a decline in offers of admission from U.S. graduate schools to prospective foreign students. This is the first decline in the rate of offers to foreign students since 2004.
While these significant reductions affected the overall decline in foreign student enrollment, the number of offers of admission to students from the People's Republic of China grew at a rate of 13 percent. The CGS press release indicates that this was the fourth year in a row of double-digit growth in the number of students from China offered admission to U.S. graduate schools.
With the up coming biggest education Expo in China (http://www.phdchina.org/english/index.shtml), the US is the country of Honour at this show. This is a clear sign that Chinese students are looking at the US as the main destination for studies and future opportunities.
There is a significant economic contribution made by foreign students in tuition and related expenditures, as well. Generally, a foreign student is required to pay tuition at the much higher out-of-state rate, even when attending a state school. The potential of Chinese students boosting the economy is significant and should not be ignored. Even Consular officers realize this factor and student visa (http://www.h1b.biz/lawyer-attorney-1137176.html) issuance to Chinese students has increased by 40% according to a recent survey.
