I need some clarification regarding my case,
--> Got H1b approved for Employer A in 2008, during stamping received 221G.
--> Submitted documents in 2009 and got stamping done in May 2009.
--> Now Employer B has applied for fresh H1B 2010.
My questions are,
When my petition is approved and having the petition in my hand, do i need to get the visa stamping before travelling for Employer B?:mad:
Will my visa stamp for Employer B only have the starting date to be from October 2011?:mad:
Is there any remote possibility that i can travel for my Employer B at any time earlier to October 2011?:mad:
Note: Have never travelled on H1 (Employer A's Petition)

Mine is approved I140. If USCIS doesn't ask for paystub then giving EVL of any consulting firm will solve the problem?
Also, my wife is working on EAD. Can she apply for H1 visa? Will it affect our GC process? I am the primary applicant.

Gurus,
I am considering switching my employer.
Currently I have I-140 and labor for GC approved in 2006.
Filed I-485 in July 2007.
My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)
Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?
Appreciate your answers in advance.

Education: MS(Ind Engg), 5+ yrs exp.
I have priority date of Oct -2007(applied for labor under EB3). Got approved I-140 in Feb 2008( EB3 category). I got promoted to next level so requested to apply for labor once again in EB2 category in Feb 2009 and got approved labor in Feb 2010.
Is there a provision to amend labor and include previously approved I-140? Or Do I have to apply I-140 once again? and my priority date would be Feb 2009?

Here is the situation:

AP is pending for 6 months with no end in sight...

Need to travel in end of June for a month:

Can I travel on AP when my H1 petition is pending?? (I do not expect that I will get it before I leave, it took more than 6 months last time). I read in many places that if you apply for H1 petition you cannot leave till it is approved, is that true???

Australia and New Zealand recently signed a memorandum of understanding [MoU] to share biometric data, an agreement that will further strengthen our nations' border security. At the Five Countries Conference (FCC) in London a memorandum of understanding was signed between Australia and New Zealand. Question is: Can she able to enter US without EAD?

MSNBC had a news piece on surprise illegal immigrants and looks like they are from India. I was surprised at a shocking 125,000 people have over stayed their visas and have become Illegal. I was worried if such news articles will reflect on our integrity and our image as knowledge workers.

Me and my husband(primary applicant) filed our I 485, I 765, and I 131. Recieved by USCIS on 06/29/2007. our lawyer recently got our reciept nos. my husband got a notice saying FP fee rejected and has been asked to re submit the fee,when, in fact all our checks have already been cashed.all of my notices say case recieved and pending.my question is ,with my husband's case in suspense, will my application be also with held or will USCIS go ahead with my application. You can stay out of the US for up to 6 months with no consequence, as long as the person has a vaild green card and passport. Over 6 months contact with the US consulate is needed and the green card holder can stay out of the country for up to a year. Over a year the green card holder will forfeit their green card and not be allowed to re-enter the country.
The US permanent resident CAN stay out of the country for more than a year if they apply for and are granted a re-entry permit by USCIS prior to leaving the country. However, for a PR to become a citizen, he/she must have 5 years of continuous residency and staying abroad for more than a year will typically break it regardless of whether a re-entry permit is issued/used.
after all there is no departure date stamped in my passport? do the airlines inform INS of passenger departure dates? does INS keep a record of departure dates of green card holders in their computers?
i know that the immigration officer at the port of entry asks "How long have u been outside the US?" In my case it will be one year and one week so can i just say "about a year"
