Hello,
My employer will be filing for my greencard (labour certification) within the next 2-3 months. I have a valid H1 B visa expiring next year. I was wondering if it is legal to travel outside the country at this stage ?
Any advice would be appreciated.

You should be good to travel as long as u have a valid H1-b for ur return trip.

Should not be a problem, your wife can work for another company, you can work part time for another company as long as you are working for the petitioner also.

not possible. Many documents in first 2 phases are companies. Its is illegal if employee is involved Labor process in any way.
Find someone who will file H1 for you next year and apply for GC....

There are two sides to the issue : strengthening the domestic workforce through education, research investment etc and then there is skilled immigration. The first half no doubt enjoys unanimous support ... however, when it comes to promoting skilled immigration, it is a pretty safe bet that the anti-immigrant lobby is going to play hard ball (already evident from the SF gate article). Overcoming this lobby is the whole challenge ..

hi, My Lawyer says that texas SWA gave him a figure of $ 105,000 annual salary as a prevailing wage for 5 years experience java,j2ee guy. After discussing with people who have already filed in EB2 i get the feeling that this is too much amount and the wage requirement is somewhere between 80-85,0000. My lawyer is trying to downgrade me to EB3. I want to contest his claim but I am not sure what mistake he has made. What questions should I ask him to figure it out. Any help would be great.

This is a much talked about subject around these days. I am sure many of us who renewed EAD but had a gap in the expiration and renewal date and were on a leave of absence. Would this be a problem when it comes to the GC processing?

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

I am now thinking of joining an Indian based company and work for same company in US. With this I can always have a base in India and can think of relocate back if need arises. Can anyone tell me the recruiting procedure for some major companies for an applicant like me ? or How to get a recruited to Indian company while being in US..??
My area of expertise is ASP.net 3.5, AJAX, SQL Server., C#. I hold BE in CS and later completed MS in US. I have been working in US from past 5 years after completing MS.

A lot of MNCs have moved IT to India and other countries - A lot of American companies do have offshore development centers in other countries - right from Microsoft, Dell, HP, AMD .................the list will go on and on - a lot of employees relocated to their home countries and some also travel back and forth on business trips ...
Now, if you think that it is in your best intrests to join companies like Infosys, TCS etc.. a lot of those jobs are filled via referrals through existing employees or once in a while they have reqruiting drive across the country

As long as you are fulfilling your obligation to work full-time with your H1-B employer, there should be no problem to do additional work in your home country in your spare time (I am assuming that you will do that remotely) from an immigration point of view. However, it is a complex situation tax-wise. In general you do have to report that overseas income in your tax return and pay tax on it. Things get even more complicated if you do not bring the income back to US but keep it in your home country ...

I recently returned from an international trip (flew into JFK), and the only document that the CIS officer asked for was my AP. Based on what my lawyers had said, the only 'required' document is your AP, although it probably doesn't hurt to have copies of the LC, I-140, I-485 (more for peace of mind!).
