My H1B was expired on DEC11,2009.My employer applied H1B extension in Oct 2009, i'm still waiting for Approval notice. since my I-94 expired on DEC11,2009. what is my status untill i get my H1b extension? will i be in leagal status until i get the H1 approval?
I have EAD with the same employer but not using.
Is anybody in the same situation?

gurus..inputs plz!
did my first MS, got First OPT ...worked on OPT..didnt find a job..
went back did my second MS..got another OPT...and moved into non-quota H1 (research field at a hospital)
now plan to go back and get an MBA..
1.) will i get an OPT after my (fulltime) MBA??? (as i already have 2 OPT's)...is there a limit of OPTS?
2.) Since i was a non-quota H1..will i have to apply for the quota H1 when and come out of MBA...which is basically a lottery system now!!! (and if i dont hit the jackpot that will put me out of status immediately after )
any inputs are appretiated!!

Last year I sent both the ITIN form and 1040 to the ITIN address. Once the ITIN is processed, they will update your 1040 with the ITIN number and forward it to the respective department for processing. I got my refund back after 8 weeks. Since I am in Texas I didnt have to file for state taxes..So not sure about the state tax filing part....

You need a copy of approved LC. However last time i remember they are fine with the "Confimation from the webpage also " Not 100% sure ..

I don't intend to get anyone's hopes high as I am not sure if this page on the USCIS website is an updated one or is an older one, but it says PP is available for 129 & 140.

I took this really lousy picture that should have been discarded
as I couldn't get a good photo out of it. I thought I'd try something
different in Photoshop anyway, I need the practice...
Here's a scaled down original of a bird taking a bath:

Recently my company got acquired by another company. Co A had filed for my LC, and was approved in Feb 09, and my i140 was filed in EB3 in Sept 09. Co B wants to keep me, and I will continue the same job. My H1 has also been transferred to Co B. My question is:
will there be any effect on my LC and I140? If so, what happens to my PD (Nov 08)
If company A got fully merged into company B and it no longer exists as a entity, then company B will have to file a successor in interest petition (I-140).

You will have 10 days from day of the denial to leave the country unless you file for Motion to Reopen (MTR).
Did you try filing another H1b through another employer after the RFE?
If that is the case and if you have the LIN number then you may be able to continue working with your current client (if new employer and client etc are ok with it).
If you have all the documents to go for MTR then you can go for it. I am not an attorney but this is per my knowledge.

My company filed my 7th year H1 extension and my wife's H4 petition at the same time in Dec 2006. USCIS online case status shows received and in process for both H1 and H4.
Recently, we upgraded to premium processing. However, only the H1 case status now shows as being done under premium processing. Does that mean that only my H1 will be premium processed and not H4 even though they both were filed together. Is this normal. I am hoping both H1 and H4 will be premium processed. I know that USCIS adjudicates H4 also in premium processing for such cases as a courtesy. Just wanted to know if anyone has been under similar situation before and got only their H1 approved in premium and not H4....The whole purpose of me upgrading to PP was to get H4 approved before the H1 quota begins in April as our H1/H4 were expiring this summer and my wife's employer is filing a H1 COS petition for her in PP under the 2008 H1 quota....Didn't want to take any chance of her H1 COS getting approved without a I-94 because of her current H4 expiring in summer.
