Hello All,
I have my EAD as does my wife. We are still on valid H1s (until 2009) and I have no plans to change my employer. We also received our travel documents. The question I have, and need your input on is can my wife travel (to India) and back on her H4 (even though we've filed for adjustment of status) or does she have to use her Advance Parole to do so?

I know this issue have been discussed several times before, but I am trying to get practical answers from Guru's.
About to apply for my Canadian PR next week and my current status is
H1B (1.5 Years Left) and US GC Status : EB-2 (India) (Aug 2006), I-140 Approved , but havent filed for I-485 yet. As one could imagine Canadian PR is just a backup and I want to understand risks and potential issues in future.
1) Does appying/getting a Canadian PR before fling I-485 a issue? I know lot of folks did it , but was trying to see how you handled the issue at 485 Stage.
2) Although, I am not expecting my I-485 dates will be current very soon, what happens in case if I apply for 485 and Canadian PR is approved.
3) Can USCIS reject your I485 process if it sees canadian PR or do they send a RFE ?? I can always say that I will forgo my canadian PR once I get US GC , but do they buy it or would they make a issue out of it.

Based on your approved I-140 if you are eligible to file 485 or get EAD then he can also get EAD.
But using only approved I-140 , then only the beneficiary can get extended.

The Majority consisting of conservative justices---- Alito, Roberts, Scalia, Thomas, and Kennedy based their decision on the history of the second Amendment, where militias were given the right to protect their farmlands. At that time we had no organized police force, we had no justice system in place.
Who are the militias of today? The KKK-- the uneducated people, who generally do not work, collect welfare checks, and blame all their owes on the colored people and now the "illegal immigrants."
If the Supreme Court grants the right to local levels to enact gun controls, one can only speculate for instance what kind of gun control laws Maricopa COunty in Arizona will enact.
Due Process protects every "individual"; it does not say "citizens". And just like every individual has the right to protect themselves with weapons, every individuals also have the more fundamental right to live.
Although the justices said that the Second Amendment allows for a reasonable restriction of guns, their rationale based on history of the second Amendment gives the militias a carte blanche right to bear arms. This can indeed set a dangerous precedence.

My 140 was denied based on the filing was Eb2 but job requirement only fits in eb3.
I filed my appeal with a new 140 on the same labor in Eb3, and in my Motion to Reopen specified to consider my old application in eb3 but if they will not to atleast consider my new application. This was an year back and I have filed premium, my new 140 was approved in 3 days, old one went AAO, but we withdrew the old one.
Talk to a good attorney, I consulted Aron Finkelstein in Murthy law firm. They were nominal and excellent customer support.

Hello All,
I applied EAD for my wife in Dec Last Week. Case is still pending with USCIS. I have to move to a different state due to job change. I have put a forwarding adress with USPS. All my mail are getting forwarded.
My question is if EAD is approved will it also get forwarded to my new address as other mail or do i need to submit a change of address with USCIS.
Did any one faced this situatin before? Please advice and share your experiences.

With full due respect to the extremely hard IIT JEE and the brilliance of the students that make it to the IIT , the reason that only 3500 make it from over 150,000 is because of India's staggering population and staggering student numbers . The US has less than a third of US's population and hence Harvard accepts 10% . It is simple math.
I feel that just because a person could not crack a question in IIT JEE and gets rejected makes him any less smarter than the ones who make it given the small number of seats that used to be sometime back .
It is good that ye government has now opened a lot more IIT's and IIM's so that more people can get the privilege of going into these elite institutionalism , the ones who missed the Institution because they could not crack one question in the JEE .

I got an email from a reporter at the Seattle Business Magazine who is writing an article on the lack of Immigration reform in the United States and how that is adversely affecting innovation and job creation.
The magazine in question is definitely not a major publication, however I think its important to highlight our case wherever possible.
Is there a 'Media Kit' on the lines of "meet your lawmaker kit' ? I looked at the "contact media" link on the home page but could not find anything.
I would be grateful if someone can point me to the relevant material, or if someone is willing to share their experience in talking to the media.

I travelled on mine 3 months after it was issued ( delay in getting wife's visa). I was questioned at the airport about the delay in travel. Explained the delay and got entry. It may be possible that they may like to speak to your immediate boss (carry his office and cell numbers)
